Time to strike with a Republican transparency and ethics agenda

With Rod Blagojevich and Charlie Rangel in the news and under pressure from the media, now is the time for the House and Senate GOP caucuses to push a real transparency and ethics agenda. On January 6th, both Houses will meet and begin the work of passing rules. We need to have some specific proposals, and this is not something that I follow well. Furthermore, the GOP ought to shoot big here. Frankly, we aren't going to run Congress for a while, so let's max this out.

Imagine some proposals:

First, in both bodies, allow individuals to submit ethics complaints and require the various ethics committees to officially reject complaints.

Second, faster and more complete campaign finance proposals. All contributions down to $5, or even just all contributions, should be disclosed. Electronic contributions should be disclosed within 72 hours, and checks should be disclosed within 72 hours of deposit. These would be real-time disclosed on the FEC website. This would solve the problem that the Sunlight Foundation and others have tried to address with S. 223.

Third, put video of all publicly accessible business meetings online. I am sure that C-SPAN and Google would be happy to help. I know that many committees keep video of markups, but release neither the video nor transcripts.

Fourth, I am sure that there are things that are specific to disclosure of financial interests that we have learned out of the Rangel affair. Throw that in.

Only the second item needs to be implemented in law. If it got to Barack Obama's desk, he would have to sign it, and it would be embarassing.

The others can be the basis of a rules fight at the beginning of the session. Make these new Democrats who ran on ethics vote against transparency and for their leadership or against their leadership.

Furthermore, let's seperate Obama from the Demcratic Congress. Let's praise his transparency measures, like disclosing meetings of his transition teams, while smacking the Congressional majorities around.

for "transparency"during the last eight years?  The House Ethics Committee was disbanded by the GOP, and VP Cheney won't even tell us where he is, much less who he is meeting with or what they are talking about..  The phrase "Republican transparency and ethics agenda" is beyond parody.

Not saying that the Democrats are any better, but this is not a winning theme as long as the same bunch of crooks run the GOP.

Ethics reform should be about...ummm....ethics??

Your first proposal - that individuals be enabled to submit ethics complaints and that the various ethics committees have to officially reject these complaints (or, presumeably. accept them) hasn't a chance in hell.

First, it is a "Nutter's Charter" - every partisan crank in the United States will start filiing ethics complaints for everything under the sun against every Congressman or Senator on the opposite side of his pet issue. Therefore, it would require an enormous staff to handle the complaints, and vast amounts of committee time to hand out the "official" rejections. I think our elected officials have got better things to do with their time.

Second, it guarantees that no Congressman or Senator will willingly serve on these committees. Not just becasue of the time problem, but also becasue this proposal is also an Opposition Soundbite Generator. Here's the scenario: There is an election coming up. You are targeting Congressman X, who sits on or chairs one of these committees. You get someone to file a bogus ethics complaint against someone who is a bogeyman in your district - for example, Barney Frank. The committe rejects the nonsense complaint. And, bingo, you've got your soundbite: Congressman X voted against holding Barney Frank  responsible for his ethics violations.

Second, I fail to see why all or small donors should have to have their privacy violated. The purpose of disclosures is to shine a light on the nexus between donations and influence. If there is a candidate I like and I want to send him a bucks to encourage him to keep up the good work, I'm not seeking a favor from him and I'm not gaining any influence over him. But if I know that my name and contact details are going to end up on a website somewhere, I probably won't make the donation. Your proposal is an unwelcome crimp on my political liberty.

And, finally, your three closing statements indicate that you aren't actually interested in ethics reform at all, you just want some stunts to cause trouble for the opposition. This is the worst possible stance to take. Ethics reform should be about, you know, ethics - not just having a snit about being the party out of power. The electorate isn't completely stupid.

Sorry but a donor is a donor and they should all be treated equally.  Exempting small donationations from reporting requirements simply encourages large donors to make a large number of unreported donations.  This may not have been a problem when the campaign finance law was passed but it is very real today.  A computer, some credit cards and a campaign that does not verify the legality of their small dollar contributions is all that is necessary to raise say $150 million in bogus donations in a single month.

All contributions should be reported and their legality verified on line.

I have no problem with allowing campaigns to withhold personal information about donors with aggreagate contributions of less than $500 as long as this info is availabe to the FEC and someone verifies that a single person is not making multiple contributions to avoid disclosure.  I would also like to see more information provided about how these small dollar contributions are raised.  This cycle saw entirely too many instances where a candidate met with business leaders and within 30-60 days several hundred thousand dollars was "donated" by employees of the firm .  Were these voluntary contributions or were the employees directed to send money?  How many employees recieved year-end bonuses that reflected the amount they contributed to their companies favorite candidate?

To get the influence, you would need to disclose this fact to the campaign, wouldn't you? (at which point they'd definitely call the cops). Besides, this strikes me as a 'you can test this' system. I.e. try donating through multiple false names and see if they get caught, not mutter about boogyemen.

Disclose every lobbyist meeting

Members should be required to disclose every meeting with a lobbyist including the agenda and basic nature of the meeting. They don't have to disclose the minutes of the meeting perhaps but a basic overview of the the purpose of the meeting is would inform voters who is weighing in on any given issue facing the congress.

Lobbyists are already required to register as lobbyists. It would be a small step for members to agree to disclose every meeting they take with a lobbyist. Make the process transparent.

Is there a danger in his constituency knowing that their Congressman is meeting with lobbyist X in order to get up to speed regarding specific matters pending before the Congress? That industry representatives are meeting with the Congressman to review legislation impacting their business? Is someone's rights violated in these scenarios?

Disagree With Campaign Donation Transparency

I would like to disagree with Item (2).

The IRS requires banks to notify when they receive deposits of $4000.00 or more from a single account.  That should be good enough for campaign reporting requirements as well.  Policing small amount donations requires the creation of oversight boards, complaint departments, and the likes....which by definition, is bigger government.  There is no, way, shape, or form we should be a part of that.

If you're worried about the thresholds, put the 3 degree principle to work.  This stops companies from writing checks to their employees so that the employees can in turn, donate to the company's candidate.

Also, limits should be removed.  Open the spicket.  There is something inherently wrong with telling someone that they can't donate what they want to whomever.  Freedom of speech is definitely in play.

And, you know, a campaign is good for the economy.  TV, Radio, Magazines, Internet, Caterers, etc. all benefit.  Big dollar campaigns are good for business.  They actually act the same as the automakers or health care does.  They are a root source of capital that gets distributed down stream.

Also, Disclosing "everything" starts to flirt with privacy rights laws which have recently been enacted in all 50 states.  You cannot store any Personally Identifiable Information about a person online without adhering to PCI encryption standards.  If there is personal disclosure, shoot, you think wiretapping personal conversations was a nightmare, imagine disclosing one's likely vote?  Stigma, community embarassment, etc....all grounds for legal action against the offending campaign.  Not only should we not disclose small donors...we should actually start to go in the opposite direction of disclosing less donors.

 

 

 

 

Simplify Matters

Depending on the individual is risky, see recent news reports (and even in the pape4rs, and on TV, too!).

Trying to pass laws to control others results in bad law.

Let us simplify the laws and rules using two concepts:  Sunshine, and sunset.

 Sunshine?  Every meeting on-the-record in  bright light, open to all, no matter what the subject.

Sunset?  Every law, rule, regulation, whatever, has an expiration event and and an expiration date which retires the law, etc unless re-enacted.
